JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Anil Kumar Sinha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody since 27.02.2017 in Dehri ( Dalmianagar ) P.S. Case No. 133 of 2017 registered for the offence under Section 272, 273 of the Indian Penal Code 1860 and section 30(a)(f), 38(i)(ii), 41(i)(ii) of the Bihar Prohibition And Excise Act , 2016 has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation as if petitioner was fleeing away after interception of Sumo vehicle, the petitioner has been made accused and from the said Sumo huge quantity of Indian make foreign liquor as well as country made liquor were recovered however , petitioner has got no connection with the said vehicle. Learned counsel for the petitioner has further argued

Patna High Court Cr.Misc. No.43168 of 2017(2) dt.19-09-2017 2/2 that besides the present case petitioner is accused in one another case but that case has got no connection with excise matter. Considering the nature of accusation as well as period of custody, let the petitioner Shashi Kumar @ Pappu @ Gorakh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram / concerned court in connection with Dehri ( Dalmianagar ) P.S. Case No. 133 of 2017 .
