The petitioner is apprehending her arrest for the offences instituted under Sections 302, 34 of the Indian Penal Code. The prosecution story, in brief, is that informant is the brother of the deceased stated, inter alia, that information came that the deceased Rina Davi has been killed by the husband Mahesh Prasad and his former wife (petitioner) because relation was strained the day deceased was married to the petitioner. The marriage was object to, by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is the first wife of the husband of the deceased. Petitioner has got no criminal antecedent. she is a lady and has

Patna High Court Cr.Misc. No.24512 of 2015 (3) dt.03-09-2015 P2/2 been implicated in this case due to mistake of fact. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances and also the fact that the petitioner is a lady, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of four weeks from today in connection with Ram Krishna Nagar P.S. Case No. 19 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
