This application has been filed for quashing the order of cognizance dated 27.11.2015 passed in Sessions Trial No.3933 of 2015, arising out of Jakkanpur P.S. Case No. 227 of 2015, by the Judicial Magistrate, 1st Class, Patna, for the offence under Sections 406, 409, 420, 467, 468, 371/120(B) of the Indian Penal Code.
Allegation has been made that huge amount of money was withdrawn from the Bank account of Joint Agriculture Director, Mechanical Cell, Patna.
Specific allegation has been made that the petitioner is the record keeper and cheque was in his possession.
Patna High Court Cr.Misc. No.19713 of 2016 (2) dt.22-09-2016 2/2 Learned counsel for the petitioner submits that money can be withdrawn only on the basis of valid signature and the Bank has found that the signature on the cheque was genuine having not been tempered in any manner. This Court does not find any error in the order of cognizance passed by the court below. Accordingly, this application is dismissed. However, the trial court is directed to expedite the trial and conclude the same as early as possible without unnecessary delay.
