JUSTICE VIKASH JAIN ORAL ORDER 11 14-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

2. It is submitted that the petitioner has been falsely implicated and no material has been brought on record to show that any amount had been taken by the petitioner from the informant nor any agreement had been executed for sale of the land and half constructed house as alleged. It is further submitted that the accusation of having advanced further loan by the informant from the account of his wife and other persons, despite nonrepayment of the earlier loan amount, is highly improbable.

3. Having regard to the nature of accusations and gravity of the offence alleged as well as the criminal antecedents of the

Patna High Court Cr.Misc. No.8942 of 2017 (11) dt.14-03-2018 petitioner involving a case of similar nature, this Court is not inclined to enlarge the petitioner on bail.

4. The bail petition accordingly stands dismissed and the provisional bail granted to the petitioner in terms of order dated 18.03.2017 is hereby cancelled. The petitioner is directed to surrender before the learned trial Court forthwith. (Vikash Jain, J) Chandran/BT U T
