ANJANA MISHRA ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.05.2018 in connection with Aurangabad (Town) P.S. Case No.98 of 2018 registered for the offence under Sections 307, 147, 148, 149, 337, 323, 435, 436, 427, 332, 333, 353, 153A, 295A, 379 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that there was an incident of stone pelting while the procession was crossing the Muslim area and some people are said to have been injured. It is submitted that the petitioner was only the bystander and that he has been roped in only because he was member of the crowd. There is no specific allegation

In view of the aforementioned facts and circumstances and that the petitioner is said to be merely member of the crowd, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No.98 of 2018.
