ANJANA MISHRA ORAL ORDER 29-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Manihari P.S. Case No. 159 of 2015 for the offences registered under Sections 448, 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is named in the first information report, the main allegation of attack is against the co-accused namely, Amzad, who is said to have assaulted with knife on the chest of the informant. It is further submitted that similarly situated coaccused persons have been extended the privilege of anticipatory vide order dated 12.05.2015 passed in Cr. Misc. No. 20441 of 2016.
Patna High Court Cr.Misc. No.21456 of 2016 (3) dt.29-07-2016 Considering the aforesaid facts and circumstances of the case and also the fact that similarly situated co-accused persons have been granted anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Katihar in connection with Manihari P.S. Case No. 159 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
