Petitioner is languishing in judicial custody since 24.05.2017 in connection with Bikram P.S. Case No. 43/2016 for offences punishable under Sections 341, 324, 307, 34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, as lodged by the informant, is that while he was going to his field at 10.00 P.M., the petitioner along with two others came and started abusing. The allegation upon the petitioner is that he opened fire which hit the informant on the thighs. The cause of occurrence was the property dispute. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and the
Patna High Court Cr.Misc. No.38961 of 2017 (2) dt.23-08-2017 2/2 injury report suggests fire-arm injury but simple in nature with no orthopedic emergency. He submits that the injury is not on the vital part of the body and that he undertakes to abide by the conditions and appear before the learned court below as and when required.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Danapur, Patna, in connection with Bikram P.S. Case No. 43/2016, subject to the condition that both the bailors would be close relatives of the petitioner.
