The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 08.02.2016 passed in Cri. Misc. No. 55091 of 2015, on the ground that the petitioner is suffering in custody since 31.05.2015, the petitioner does not belong to any gang, no T.I.P. has been conducted and further up till now no prosecution witness has been examined though charges have been framed on 20.04.2016 and as such, in near future the trial is not likely to be concluded.

The learned A.P.P. opposes the prayer of bail by submitting that the petitioner was apprehended with looted Sumo Victa vehicle and further he has confessed his guilt.

No.39041 of 2017 (2) dt.23-08-2017 2/2 In the facts and circumstances stated above, at this stage finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trail No. 71 of 2016/ 112 of 2016, arising out of Kanti P.S. Case No. 223 of 2015, pending in the court of learned 10th Additional Sessions Judge, Muzaffarpur. However, considering the detention of the petitioner, let the trail be expedited and concluded as early as possible preferably within six months after taking the same on priority basis, from date of receipt/production of a copy of this order.
