====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 102 of 2017 for the offences punishable under Sections 307, 341, 447, 379, 504/34 of the Indian Penal Code.
The case of the prosecution is that the son of the informant was going to flour mill for thrashing wheat and in the way one Anil Kumar hit the informant's son for which the informant went to the house of Anil Kumar to complaint about the incident to the father of Anil Kumar, whereupon the petitioner and other accused persons assaulted informant, resulting in injuries on the person of the informant.
The learned counsel for the petitioner submits that

No.45823 of 2017 (2) dt.20-09-2017 2/2 the injuries are not serious in nature and as far as the case pending against the petitioner is concerned, he has already been granted bail. It is further submitted that there is animosity between the parties for which such incident had taken place and the petitioner has been falsely implicated. It is further submitted that the petitioner is languishing in jail since 5.8.2017. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 102 of 2017.
