Petitioner, already in custody, seeks bail in connection with Khagaria (Muffasil) P.S. Case No.155 of 2018 registered under Sections 341, 323, 307, 385, 386, 427 and 504/34 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that the accused persons made demand of extortion and opened fire but did not hit anyone thereafter they assaulted the informant and his nephew causing injury in the leg of his nephew.

Learned counsel for the petitioner submits that the petitioner was armed with firearm but no firearm injury is cause rather allegation is that he assaulted otherwise and the injury is also on the leg and the petitioner is in custody since 22.03.2018.
