The petitioners seek bail in a case registered under Sections 302/34 of the Indian Penal Code.

The prosecution case in brief is that the informant's son was brutally assaulted by the accused persons, as a result of which, he succumbed to the injuries.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 27-06-2019. Charge sheet has already been submitted. The name of the

Patna High Court CR. MISC. No.14570 of 2020(2) dt.03-03-2020 2/2 petitioner has transpired in this case merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the participation of the petitioners in the present case.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioners named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S.
