ANJANA MISHRA ORAL ORDER 11-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No.C-II 131 of 2013 for allegedly having committed the offence under Section 47(A) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries are not said to have been made from the conscious possession of the petitioner; rather raid was conducted at Akashi More in the house of Pashupati Choudhary and also a hut located at a few yards away from the said house.

Considering the fact that only allegation against the

No.30449 of 2015 (2) dt.11-08-2015 2/2 petitioner is that he had been seen fleeing away from the place of occurrence, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, District-Siwan, in connection with Complaint Case No.C-II 131 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
