The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2116 of 2015 dated 15.09.2015 instituted for the offences under Sections 406, 420 and 120B of the Indian Penal Code.

From the perusal of the complaint itself, it would appear that on the assurance of co-accused, viz. Saharyar Abdin, money was deposited by the complainant in Wealth Agro Industries Ltd.

Learned counsel for the petitioner has submitted that the aforesaid company is incorporated under the Indian

Patna High Court Cr.Misc. No.48016 of 2017 (4) dt.18-01-2018 2/2 Companies Act, 1956 and the brother of the petitioner had been managing the affairs of the company. The petitioner has only been shown as a cashier in the complaint petition. It has further been submitted that some of the other co-accused persons, who are his family members, have been granted anticipatory bail. Co-accused Saharyar Abdin was in jail and he too has been granted bail. Considering the nature of allegation, the petitioner above named is directed to be released on bail, in the event of his surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Bhagalpur in connection with Complaint Case No. 2116/2015.
