The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 365, 366 & 34 of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. The victim, in her statement recorded under Section 164 Cr.P.C., has specifically stated that out of her own sweat will, she went with this petitioner and solemnized marriage with him. No one has kidnapped her. The victim is major and aged about 19 years. Petitioner has got clean antecedent.

Considering the statement of the victim recorded under Section 164 Cr.P.C., in the event of arrest/surrender within a period of six weeks from today, let the above named

No.16683 of 2023(2) dt.19-05-2023 2/2 petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj P.S. Case No. 675 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
