The petitioner seeks bail in a case registered under Sections 341, 307, 302, 504/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in brief is that while the informant along with his family members was chatting outside his house, the accused persons armed with weapons came there and in consequence thereof, the accused persons shot at informant's brother, who in course of treatment, died.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-09-2019. Charge sheet has
Patna High Court CR. MISC. No.14672 of 2020(2) dt.03-03-2020 2/2 already been submitted. The main allegation of firing upon the deceased is alleged against Manoj Kumar Singhj @ Manti. No overt act is alleged against the petitioner. No injury has been caused by the petitioner. The petitioner is said to be a member of mob.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Fulwaria P.S. Case No. 124 of 2019.
