The Petitioner who is in custody seeks bail in connection with Sessions Trial No. 345 of 2017 arising out of Phulwarisharif P.S. Case No. 27 of 2017 registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is of committing murder along with other accused persons. It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case on mere suspicion. It has been further submitted that there is no eye witness to the said occurrence. Similarly situated co-accused persons have been granted bail by a co-ordinate

No.38819 of 2017(2) dt.19-08-2017 2/2 bench of this court vide orders dated 06.07.2017, 04.08.2017, 11.08.2017, in Criminal Miscellaneous No. 28394 of 2017, Criminal Miscellaneous No. 29214 of 2017 and Criminal Miscellaneous No. 31888 of 2017. The petitioner is in custody since, 16.01.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Patna in connection with Sessions Trial No. 345 of 2017 arising out of Phulwarisharif P.S. Case No. 27 of 2017.
