JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of regular bail, arises out of Kutumba Police Station Case No. 54 of 2017, disclosing offences under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 17 of the C.L.A. Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner rather the petitioner has falsely been made accused in this case due to political rivalry. Further, charges have been framed in this case and a supplementary affidavit to that effect has also been filed

Patna High Court Cr.Misc. No.36866 of 2017 (3) dt.07-09-2017 by the petitioner. The petitioner is rotting in judicial custody for more than four months.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kutumba Police Station Case No. 54 of 2017.
