JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Mufassil P.S. Case No. 220 of 2015, dated 20.09.2015, instituted for the offences punishable under Sections 143, 147, 186, 188, 353 and 504 of the Indian Penal Code.

The petitioners and about two hundred fifty villagers had blockaded a road and were demanding arrangements for availability of water. The accused persons

Learned counsel for the petitioners has submitted that though they have been named in the F.I.R., but nothing specific has been alleged against them. They are, if at all the prosecution story is to be believed, members of the mob. Regard being had to the fact that the petitioners do not have any criminal antecedents and the nature of accusation levelled against them, this Court is inclined to enlarge them on anticipatory bail.

Let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Mufassil P.S. Case No. 220 of 2015 in connection with learned 2nd Additional Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
