====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 411, 412, 413, 414 and 420/34 of the IPC.

The prosecution story, in brief, is that on 06.12.2019 at about 1.30 A.M. during the course of checking, the informant apprehended co-accused Raja Ram Sah and Kaila Paswan (petitioner) with two motorcycles. Out of which, Motorcycle bearing No. BR09Z 2204 is different from the paper. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 12.12.2019. The petitioner has falsely been implicated in the present case. Patna High Court CR. MISC. No.14652 of 2020(2) dt.04-03-2020 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner had no knowledge that the Motorcycles in question are stolen property. He has been made accused in the present case due to mistake of fact. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Begusarai, in connection with Nima Chandpura P.S.Case No. 77 of 2019.
