Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 07-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegedly, petitioner succeeded to get government employment on the post of Shiksha Mitra by using forged matriculation certificate.

The main submissions advanced by the learned counsel for the petitioner are that in the light of direction given in PIL bearing CWJC No. 15459/2014 documents of all Shiksha Mitras were examined across the State of Bihar and many of them were found to be guilty of using forged documents in whom some were granted

Further submission is that petitioner has been languishing in jail since 30.12.2021 having no criminal antecedent. Learned APP has opposed the prayer for bail.

Having considered above submissions as well as the facts that in respect of alleged offences the prosecution is mainly relying upon documentary evidence which is stated to be in the possession of the prosecution and the petitioner has got no criminal antecedent as mentioned in his petition and has been languishing in jail since 30.12.2021, in my view, a lenient approach may be taken in respect of the petitioner. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S Case No. 808 of 2021.
