The petitioners apprehend their arrest in registered for the offences punishable under Section 353 and other Sections of the Indian Penal Code.
The petitioners are named in the FIR and it is alleged that they blocked the road, pelted stones after raising slogans against the police officers.
It is submitted that there is counter version of the case. No specific allegation is made against the petitioners. Similarly situated co-accused Vikki Ojha @ Mohan Kumar Ojha, Anant Mani Triapathi, Tinku Kumar Sah and Mithun Kumar Sah have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 18066 of 2015 on 09.07.2015 and the case of the
Patna High Court Cr.Misc. No.26883 of 2015 (2) dt.21-07-2015 2/2 petitioners stand on the same footing.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Sidhwalia P.S. Case No. 104 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
