The petitioners seek bail in a case instituted for the offences under Sections 366/34 of the Indian Penal Code. The prosecution case in short is that the accused persons abducted the daughter of the informant. It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.12.2018 and petitioner no. 2 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Chargesheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. On recovery,

No.15835 of 2019(3) dt.29-04-2019 2/2 the statement of the victim has been recorded under Section 164 Cr.P.C. in which there is no allegation of physical or sexual abuse against the petitioner. There is a title suit pending between the father of the petitioner and father of the informant. For the said reason, the present case has been instituted. On behalf of the State, it is submitted that the petitioners are named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, Rohtas in connection with Dinara P.S. Case No. 319 of 2018.
