This is an application for bail in connection with Tajpur P.S.Case No. 82 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of one country made pistol and one cartridge from his possession and it further appears from the petition that petitioner is accused in six other cases.
Submission of learned counsel for the petitioner is that two persons were arrested but other co-accused has been granted bail and petitioner is in custody since 25.3.2017. Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.42376 of 2017 (3) dt.18-09-2017 2/2 Having heard both sides and in view of facts and circumstances and also in view of the fact that other co-accused has been granted bail having no criminal antecedent, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
