JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2018 The application for grant of regular bail arises out of Gaighat P.S. Case No. 35 of 2018, dated 19.02.2018, instituted for the offences punishable under Sections 341, 323, 354, 376 and 511/34 of the Indian Penal Code. The sister-in-law of the informant is said to have been abducted for immoral purposes while she had come out of the house along with her mother-in-law for attending to the call of nature.
Learned counsel for the petitioner has drawn the attention of this Court to the fact that on the same day and at practically at the same time, the informant was waylaid by
Patna High Court Cr.Misc. No.34230 of 2018 (3) dt.06-07-2018 2/2 the brother of the informant. His motorcycle was snatched and he was assaulted brutally, leading to fracture of one of the bones of his body. The present case has only been filed by the informant in order to save his brother, who is an accused in the case referred to above, viz. Gaighat P.S. Case No. 36 of 2018.
The narration in the F.I.R. also does not appear to be trustworthy as the victim/sister-in-law of the informant would not be left on the road for her to take the name of the miscreants.
The petitioner does not have any criminal antecedent.
Regard being had to the period of custody of the petitioner above named which is from 20.02.2018, he is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-16-Cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Gaighat P.S. Case No. 35 of 2018.
