The petitioner is apprehending his arrest in connection with Complaint Case No. 406 of 2014 for the offences instituted under Sections 498-A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition dowry Act.
The prosecution story, in brief, is that petitioner married Guriya Kumari (the complainant) on 02.05.99 and started demanding Rs. 50,000/- for which a case had been filed in Hajipur Court which was disposed of with the undertaking and bond that the petitioner will keep the complainant with full dignity and will not torture her. According to complainant, on 03.04.2014 the petitioner alongwith others tried to kill her on Mahatama Gandhi
Patna High Court Cr.Misc. No.24106 of 2015 (3) dt.02-09-2015 P2/3 Setu but saved by the passengers.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It further submitted that the petitioner is ready to deposit a sum of Rs. 1500/- per month in the Court below which shall be deposited in favour of the complainant.
On behalf of the State and informant, it has been submitted that the petitioner is named in the complaint case and petitioner is the husband of the victim.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 1500/- per month in favour of the complainant, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Complaint Case No. 406/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna City, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
