ANJANA MISHRA ORAL ORDER 13-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 20.04.2018 in connection with Town P.S. Case No. 645/17 registered for the offences punishable under Sections 341/323/379/406/419/420/ 504/506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that an all together mischievous case has been lodged against him with vague and indistinct allegations. It is further submitted that the informant had taken several cheques as they were in business transaction and when the relationship soured, the cheque has been illegally presented. However, no case under the N.I. Act has been filed and all of a sudden, the present case has been instituted

Learned counsel for the informant submits that the petitioner is wholly guilty and has taken money from the informant and has not returned the same and illegally issued a cheque knowing fully well that his the account has been found closed.

Considering the fact that no case under the N.I. Act was ever registered by the informant and the allegations are vague and indistinct, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Town P.S. Case No. 645/17.
