JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Uphara P.S. Case No.33 of 2016, registered for offences alleged under Sections 304B, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner, at the outset, submits that the petitioner is the husband and he is in custody since 01.07.2016. Submission of the learned counsel is that the allegations against him are false and flimsy and in fact it was the deceased herself tried to commit suicide.

On the other hand, learned APP opposed the prayer for bail.

Patna High Court Cr.Misc. No.38546 of 2017 (2) dt.19-08-2017 Considering the facts and circumstances of the case, particularly that the petitioner is the husband and the marriage was only of the year 2014 and death has taken place within a period of two years of marriage, I am not inclined to grant regular bail to the petitioner. The learned trial court is, however, directed to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order.

The application stands disposed of with the aforesaid direction.
