Petitioner, already in custody, seeks bail in connection with Kasba P.S. Case No.52 of 2018 registered under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation in brief is that the daughter of the informant was kidnapped by Rajiv Kumar, when the informant went in search of his daughter, the petitioner is said to have assaulted him.

Learned counsel for the petitioner submits that the girl has named others regarding her kidnapping and committing gang rape but she has not levelled such allegation against the petitioner, even in the FIR, there is no allegation of kidnapping against the petitioner. Having considered the aforesaid facts and circumstances, petitioner Mant Lal Roy is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Kasba PS Case No.52 of 2018.
