The petitioners apprehend their arrest in Phulwaria P.S. Case No. 116/2017, registered for the offences punishable under Section 147, 148, 149, 153(A), 353(A), 295(A), 332, 327, 337, 307 and 427 of the Indian Penal Code and section 27 of the Arms Act.
The S.H.O. of Phulwaria P.S. named 44 persons and alleged that all the named accused along with 500 unknown persons formed unlawful assembly and started playing vulgar songs while they were taking procession on the eve of Durga Puja. They were raising slogans against other community. When the police asked not to raise such slogans, the members of the mob

Learned counsel for the petitioners submits that of course, petitioners are named in the F.I.R., but no specific allegation is made against the petitioners. Similarly situated many other accused persons have been granted anticipatory bail vide orders passed in Cr. Misc. 3059/2018, Cr. Misc. 3077/2018 and Cr. Misc. 3951/2018 by coordinate benches of this court. Considering the facts aforesaid and the fact that similarly situated co-accused persons have already been granted anticipatory bail by coordinate benches of this Court, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Begusarai in connection with Phulwaria P.S. Case No. 116/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) Vinita/- U T
