The petitioner apprehends his arrest in connection with Hilsa P.S. Case No.101 of 2020, registered for the offences punishable under Sections 498A, 494, 323, 504 and 34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner along with his family members tortured the victim physically and mentally and ousted her from her matrimonial home. It is also alleged in the FIR that the petitioner has solemnized the second marriage with another girl. By order dated 04.04.2022, the I.O. concerned was
Patna High Court CR. MISC. No.27087 of 2021(4) dt.16-05-2022 2/2 directed to report to this Court that whether the petitioner has solemnized second marriage with another girl or not. Learned APP for the State has filed an affidavit stating therein that the petitioner has solemnized second marriage. Learned APP has annexed the report with the affidavit as Annexure-A series.
Taking into consideration the fact that petitioner has given wrong statement on oath, I am not inclined to enlarge the petitioner on anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
