The Petitioner who is in custody seeks bail in connection with L.N.M.U P.S. Case No. 149 of 2016 registered for the offence punishable under Sections 413, 416, 401, 420, 467 and 468 of the Indian Penal Code. It has been alleged in the FIR that on receiving secret information that three accused persons were fleeing away on motorcycle, the informant and other police officials chased them. During chase the motorcycle fell down and two accused persons managed to flee away whereas the petitioner was apprehended at the spot.
It has been submitted on behalf of the petitioner
Patna High Court Cr.Misc. No.38956 of 2017(2) dt.19-08-2017 2/2 that nothing has been recovered from the possession of the petitioner except one mobile phone. It has been further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide orders dated 22.10.2016, 28.02.2017 and 07.02.2017 in Criminal Miscellaneous No. 46405 of 2016, Criminal Miscellaneous No. 55352 of 2016 and Criminal Miscellaneous No. 5577 of 2017. The petitioner has got no criminal antecedent and is in custody since, 27.06.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Darbhanga in connection with L.N.M.U P.S.
