The petitioner seeks bail in connection with Danapur R.P.F. Case no. 01 of 2017 registered under Sections 3 R.P. (U.P.) Act.

Some railway property is said to have been stolen by some unknown miscreants by breaking the window of the store. It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. His name is surfaced on the basis of his confessional statement which has no evidentiary value in the eye of law. Though, one more case has also lodged against him, but he is on bail in that case. The petitioner has been languishing in custody since 17.02.2017.

Patna High Court Cr.Misc. No.39717 of 2017 (2) dt.21-08-2017 2/2 Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Railway, J.M. 1st Class, Ara at Bhojpur in connection with Danapur R.P.F. P.S. Case no. 01 of 2017.
