The petitioner apprehends his arrest in a case under Sections 414/34 of the Indian Penal Code.

On secret information, the house of the petitioner was raided but the petitioner was not found in his house. On search, one stolen motorcycle is said to have been recovered. Dablu Sharma, the brother of the petitioner, disclosed that the petitioner and his friend had brought that motorcycle. Dablu Sharma has already been granted regular bail vide order passed in Cr. Misc. No. 22381/2015.

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in Gobindganj P.S. Case No. 40 of 2015. Accordingly, the same is rejected.

Patna High Court Cr.Misc. No.24931 of 2015 (2) dt.14-07-2015 2/2 The petitioner is directed to surrender in the court below within four weeks from the date of receipt / production of a copy of this order and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order and taking into consideration that similarly situated co-accused Dablu Sharma has already been granted regular bail.
