JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 365, 366/34 of the Indian Penal Code.
Prosecution case is that this petitioner and other accused persons are alleged to have abducted the victim girl for the purpose of marriage.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that the victim in her statement recorded under section 164 Cr. P. C. has not taken name of the petitioner. She has stated that she solemnized marriage with Golu Gautam. She states to be major in the said statement. Petitioner has got no criminal antecedent. Patna High Court CR. MISC. No.17197 of 2022(2) dt.29-08-2022 2/2 already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 15976 of 2022. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge XIV, Begusarai in Khodawandpur Police Station Case No. 82/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
