JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 506, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is of making indiscriminate firing causing injury to Sachin, Nitesh and others.
It is submitted by learned counsel for the petitioners that during investigation, it was transpired that the firing was made by co-accused Ashok. The FIR suggests omnibus and general accusation levelled in the background of dispute between the parties from before. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.20234 of 2015 (3) dt.21-05-2015 2/2 petition that the petitioners have no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Sasaram (Model) P.S. Case No. 692 of 2014 pending in the court of learned CJM, Sasaram, Rohtas. Accordingly, the application is disposed of.
