====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2018 Heard Sri S. Jamil Akhtar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner , who is in custody since 4.2.2018, has prayed for grant of bail in connection with Bhadwar P.S. Case No. 2 of 2018 , registered for the offence under Section 25(1-B)A/ 26/ 35 of the Arms Act & Section 17 of the C.L.A. Act. Learned counsel for the petitioner submits that petitioner has falsely been implicated as if he was found at the raiding place from where prohibited arms and other ammunitions including literature relating to 'Naxalite' were recovered.
Besides hearing, I have perused the materials available on record particularly the F.I.R. On perusal of the F.I.R. itself it is evident that raid was conducted under the
Patna High Court Cr.Misc. No.34065 of 2018(3) dt.04-07-2018 2/2 leadership of C.R.P.F. and from one house huge quantity of arms and ammunitions including S.L.R. with other materials were recovered showing that persons assembled were members of prohibited group.
In view of seriousness of accusation, there is no reason to pass favourable order.
The petition stands dismissed.
