The petitioner apprehends his arrest in Rafiganj P.S. Case No. 39/2016 registered under Sections 409, 188/34 of the Indian Penal Code.

The petitioner was appointed in Rafiganj Panchayat in the year 2013. The appointment of teachers was made in the year 2006 and at that time Dineshwar Rajwansi was the Panchayat Sachiv for the period 2005 to 2013 and Dineshwar Rajwansi did not hand over the folder registers of teachers' appointment to the petitioner. When the petitioner was directed to hand over the folder registers of teachers' appointment, the petitioner wrote a letter to the Block Education Extension Officer vide his letter dated 28.01.2016 but no attention was paid to the letter of the petitioner.

No.22224 of 2016 (3) dt.21-07-2016 2/2 Considering the fact that the petitioner was not the In-charge of the Panchayat during the period of appointment of teachers nor the folder registers of teachers' appointment was given to the petitioner by his predecessor, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Rafiganj P.S. Case No. 39/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
