JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
The accusation is of killing the granddaughter of the informant within one year of marriage for nonfulfilment of dowry demand. It is alleged against the petitioner that petitioner having some business relationship with the elder brother of the husband of the victim has instigated the inlaws of the victim for killing. It is submitted by learned counsel for the petitioner that since the petitioner is a business partner of the brother of the husband of the victim, hence he has been roped in the present case. The accusation is not specific against the petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.20469 of 2016 (2) dt.09-05-2016 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Motipur P.S. Case No. 30 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
