JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 307, 379, 324, 326, 341 and 506/34 of the Indian Penal Code. As per the allegation contained in the First Information Report, the petitioners had assaulted the informant and one Ravi Pandey with knife causing multiple injuries upon them. It is also alleged that they were taken to Anugrah Magadh Medical College & Hospital, Gaya whereafter they were referred for treatment to Patna. Pursuant to order of this Court, the case diary has been made available. On perusal of which, it appears that

Patna High Court Cr.Misc. No.2983 of 2015 (3) dt.21-05-2015 2/2 the Police have referred to the details of injuries found on the person of the injured by a Doctor of Mithila Emergency Hospital, New Bypass, near Nandlal Chhapra, Bhootnath Road, Bahadurpur Housing Colony, Patna. A copy of the said injury report has been shown to me by learned counsel appearing on behalf of the informant, which does not inspire much confidence. This application is, accordingly, allowed.

Let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 166 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
