The petitioner is in custody since 10.04.2018 in connection with Madhepura P.S. Case No. 424 of 2017 for the offence registered under Sections 341, 323, 324, 307 read with Section 34 of the Indian Penal Code.

Learned Senior counsel for the petitioner submits that the entire altercation took place between the parties after a small dispute, which led to a free fighting resulting in injury on both sides. There is no repetition of blow at the hands of the petitioner and both sides have sustained injuries.

Considering the aforesaid facts and circumstances of the case and that there is no repetition of blow at the hands of the

No.34164 of 2018 (3) dt.13-07-2018 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 424 of 2017.
