JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 324, 326, 307 and 302 of the Indian Penal Code.
It is alleged that 14 persons including the petitioner came variously armed when on the order of this petitioner, coaccused Ranjan Kumr inflicted injury with sickle to Chandan Choudhary as a result he fell down then co-accused Suraj Kumar inflicted injury with sickle on the neck of the informant. Subsequently, Chandan Choudhary succumbed to the injuries. It is submitted by learned counsel for the petitioner that accusation of assault is not against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.20982 of 2015 (2) dt.21-05-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Amarpur P.S. Case No. 91 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
