This application for regular bail arises out of Jandaha P.S. Case No. 124 of 2019, disclosing offences punishable under Sections 13(1) (a) (b), U.A.P. Act and Section 25(1-b)A, 26 and 35 of the Arms Act.

It is alleged in the F.I.R. that the police received an information to the effect that persons named in the F.I.R. were going to assemble and hold a meeting in orchard. When the police reached at the concerned place, they saw some persons fleeing away out of whom two persons namely Sonu Sahni and Rohit Sahni were apprehended. From the possession of Rohit Sahni, one loaded country-made pistol with one cartridge was recovered. The persons who were apprehended are said to have

Learned counsel appearing on behalf of the petitioner has submitted that except for the disclosure made by the co-accused naming the petitioner, as the one who had fled away among others, there is no recovery of any incriminating material from the petitioner's possession.

Considering the above submission, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Vaishali, Hajipur in connection with Jandaha P.S. Case No. 124 of 2019.
