This is an application for bail in connection with Lauriya P.S.Case No. 147 of 2017 registered for the offences punishable under Sections 272, 273, 420, 467, 468, 471, 120B, 414 of the Indian Penal Code and 30(a), 35(a), 36, 38, 41 and 47 of Bihar Prohibition of Excise Act, 2016.
Allegation as per FIR is of recovery of foreign liquor. Submission of learned counsel for the petitioner is that nothing specific has been made about recovery against the petitioner and he has falsely been implicated in this case. Further submission is that he is in custody since 2.6.2017 having clean antecedent. Further submission is that other co-accused persons have been granted bail.

Patna High Court Cr.Misc. No.36975 of 2017 (4) dt.30-08-2017 2/2 Having heard both sides and in view of facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran, Bettiah, in connection with Lauriya P.S.Case No. 147 of 2017, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
(iii) If active involvement of the petitioner in such type of cases is found in future, his bail bonds shall be cancelled.
