JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. Earlier the prayer for bail of the petitioner was rejected taking note of allegation levelled against the petitioner and the impugned order dated 13.07.2017 passed by learned trial court goes to show that altogether seven prosecution witnesses have already been examined. Therefore, it is obvious from the aforesaid fact that trial of the petitioner is going in full swing. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the
Patna High Court Cr.Misc. No.41961 of 2017 (4) dt.18-10-2017 2/2 petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 445 of 2016 arising out of Khirhi Mor P.S. Case No. 72 of 2014 pending in the court of Additional Sessions Judge-II, Danapur stands rejected.
