JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner and APP for the State.
The petitioner seeks bail in connection with Bagaha (Pathkhauli) P.S. Case no. 65 of 2017 registered under Sections 147, 148, 149, 323, 324, 307 and 504 of the Indian Penal Code. The petitioner is said to have assaulted on the head of the friend of the informant namely, Sonu Pathak while the Umesh Yadav assaulted on the head of the informant by means of iron rod causing grievous injuries to them over dispute on dashing the motorcycle of the informant by the bullock-cart of the father of the petitioner.
It is submitted by the learned counsel for the petitioner that there was no intention to do away with the life of the victim as
Patna High Court Cr.Misc. No.38113 of 2017 (2) dt.10-08-2017 the occurrence took place over the trivial matter of dashing the motorcycle of the informant. The petitioner is languishing in jail since 18.02.2017. The co-accused Umesh Yadav has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 10.08.2017 passed in Cr. Misc. no. 35825 of 2017. Having considering the facts and circumstances of the case, let above named petitioner, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Bagaha, District-West Champaran in connection with Bagaha (Pathkhauli) P.S. Case no. 65 of 2017.
