Petitioner, already in custody since 15.9.2017 seeks bail in Town PS Case No. 512 of 2017, registered under Sections 420, 379 and 120B of the IPC.

The allegation in brief is that some unknown miscreants committed robbery and took away Four lakh five thousand rupees. Learned Counsel for the petitioner submits that there is no allegation against the petitioner, neither there is any recovery nor any test identification parade was held rather the petitioner was apprehended and identified at the police station, there is only one antecedent against him in which he is on bail, similarly situated coaccused Dilip Sahni has already been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 26848 of 2018 so the petitioner seeks bail on the ground of parity. Having considered the said facts and circumstances, the petitioner Amit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM 9th (East) Muzaffarpur in connection with Town PS Case No. 512 of 2017.
