The petitioner seeks regular bail in connection with Rail P.S. Patna Junction (Rajendra Nagar T) PS case no. 406 of 2018 registered for the offence punishable under Section 379/34 of Indian Penal Code.

The allegation is regarding the informant having found the chain of her purse in an open condition and upon further scrutiny, it was found that her mobile phone had been stolen, whereafter the passengers had searched the bag of the persons standing there and from the petitioner herein, a sum of Rs. 800/- was recovered.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present

Patna High Court CR. MISC. No.15720 of 2019(2) dt.26-03-2019 2/2 case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 11.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway, Patna in connection with Rail PS Patna Junction (Rajendra Nagar T) case no. 406 of 2018.
