The petitioner is apprehending arrest in a case registered for the offences punishable under 47a of the Excise Act.

It is alleged that the petitioner left his motorcycle on being chased by the informant and from the motorcycle 35 liters of 'mahua' liquor were recovered.

It is submitted by learned counsel for the petitioner that recovery cannot be treated from the possession of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.25848 of 2015 (2) dt.17-07-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with G.O. Excise Case No. 25 of 2015, pending before the learned Chief Judicial Magistrate, Nawada.

With the above observation, this application is, accordingly, disposed off.
