JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Brahampura Case No. 178 of 2014 registered under Sections364A/34 of the Indian Penal Code. The co-accused Ram Pravesh Sahani was caught by the police on the basis of information, given by the informant. The apprehended co-accused Ram Pravesh Sahani disclosed the name of petitioners and others as his associates.
Submission on behalf of petitioners is that except so-called confessional statement of co-accused Ram Pravesh Sahani, there is nothing against the petitioners and moreover, the informant has not disclosed the name of petitioners in his
Patna High Court Cr.Misc. No.21311 of 2016 (3) dt.08-11-2016 2/2 statement, recorded u/S 164 of the Cr.P.C.
It is a serious case of Section-364A/34 of the Indian Penal Code and name of the petitioners came in confessional statement of co-accused, who was caught by the police on the basis of identification, made by the informant and, therefore, I am not inclined to extend the privilege of anticipatory bail to the petitioners.
Accordingly, prayer for anticipatory bail of the petitioners stands rejected.
