JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 494 of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

The accusation is of torture and performance of second marriage.

It is submitted by learned counsel for the petitioner that the complainant has performed second marriage with one Jainath Yadav, brother in law of the petitioner and the sister of the petitioner has filed Complaint Case No. 282 of 2012 making

Patna High Court Cr.Misc. No.32648 of 2014 (2) dt.09-02-2015 2/2 accusation under sections 498A, 380,323,494 and 504 IPC and section 4 of Dowry Prohibition Act making the complainant as an accused then the present complaint has been filed. The said complaint has been brought on record as Annexure 2. Considering the fact that sister of the petitioner has filed complaint at earlier point of time, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Complaint Case No. 156 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
